This Privacy Policy explains how DerbyParty collects, uses, and protects information when you use the application and participate in an event operated through DerbyParty.
We may collect your name, mobile phone number, optional email address, account credentials, profile image, wagers, token activity, event participation, and technical information needed to operate and secure the service. We also record the date and time of your consent to receive text messages.
We use your information to create and validate your account, administer events, process wagers and event tokens, send service and event notifications, provide support, prevent fraud or misuse, maintain records, and comply with applicable law.
If you opt in during account creation, DerbyParty may send automated text messages for account validation, password resets, account security, and notifications related to the event. Message frequency varies during the event. Message and data rates may apply. Reply STOP at any time to stop messages or HELP for help. Consent is not a condition of purchase.
Stopping text messages may prevent delivery of account validation or event updates. You may contact the event organizer for available alternatives.
We may share information with the event organizer and service providers that help operate DerbyParty, including hosting, database, security, and communications providers such as Twilio. These providers may use information only to perform services for us. We may also disclose information when required by law, to protect rights or safety, or as part of a business transfer.
We do not sell or rent personal information. Mobile information, text-message opt-in data, and consent will not be shared with third parties or affiliates for their marketing or promotional purposes.
We retain information for as long as needed to provide the service, maintain event and transaction records, resolve disputes, and meet legal obligations. We use reasonable administrative and technical safeguards, but no electronic system is completely secure.
You may review or update account information through your account settings. You may opt out of text messages by replying STOP. Requests to access, correct, or delete other personal information may be directed to the organizer of the event through which you received access to DerbyParty, subject to legal and recordkeeping requirements.
DerbyParty is not directed to children under 13, and we do not knowingly collect personal information from children under 13.
We may update this policy and will post the revised date on this page. Questions about this policy or DerbyParty's privacy practices should be directed to your event organizer.

These Terms and Conditions govern your access to and use of DerbyParty. By creating an account or using the application, you agree to these terms and our Privacy Policy.
You must be legally permitted to participate under the laws and rules applicable to your event. The event organizer may impose additional eligibility, wagering, payout, or conduct rules. You are responsible for confirming and following those rules.
You must provide accurate information, protect your password and account code, and promptly report suspected unauthorized use. You are responsible for activity performed through your account. We may suspend or close accounts that contain false information, compromise security, violate these terms, or interfere with an event.
When you actively select the SMS consent checkbox, you agree to receive automated text messages from DerbyParty at the mobile number you provide. Messages may include account validation, password resets, security notices, and event notifications. Message frequency varies during the event. Message and data rates may apply. Reply STOP to opt out or HELP for help. Consent is not a condition of purchase.
You represent that you are the subscriber or customary user of the number provided and will notify us if that number changes. Carriers are not liable for delayed or undelivered messages.
DerbyParty records event tokens, wagers, race results, and payouts as configured by the event organizer. Displayed odds and projected payouts may change until results and pools are final. The event organizer is responsible for event administration and final decisions concerning scratches, results, payouts, refunds, and disputes.
You may not misuse the application, attempt unauthorized access, disrupt its operation, manipulate event data, impersonate another person, use automated means to access the service without permission, or use DerbyParty for unlawful activity.
We may modify, suspend, or discontinue any part of DerbyParty. We do not guarantee uninterrupted or error-free operation, delivery of notifications, or availability on every device or network.
DerbyParty is provided "as is" and "as available" to the fullest extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by law, DerbyParty and the event organizer will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the application.
We may update these terms by posting a revised version and date. Continued use after an update constitutes acceptance of the revised terms. Applicable law and any event-specific dispute procedures will govern disputes. Questions should be directed to your event organizer.
